You guys, Vikings linebacker Erin Henderson is NOT a smashed-lete. He is so adamant about proving this that he’s actually suing the Department of Public Safety in Eden Prairie, Minnesota for taking his license away.
On November 19, 2013, Henderson was pulled over on suspicion of driving under the influence. According to a petition filed in Hennepin County District Court, police took Henderson’s BAC where it measured at .11.
Um… hello? The legal limit is .08. So…
Well, now, the story gets interesting. There’s no record of Henderson being charged with a crime nor is there any record of him being booked into Hennepin County Jail. Yet, his driver’s license was still revoked.
So, is he being charged with a DUI or not?
Needless to say, Henderson did retain attorney David Valentini (isn’t that the name of a drink?) to represent him.
Henderson is saying the police forced him to be stopped and tested for a DUI without a probable cause.
According to Henderson’s argument, the police did not have “articulable grounds to make an investigatory stop” and police did not have a “reasonable and probable cause” to accuse him of drinking and driving.
Henderson said that the Eden Prairie police told him that it was a crime to refuse a BAC test. However, if there were no probable cause, it would render “the threat unconstitutionally erroneous and coercive,” according to Henderson’s petition that he filed yesterday.
Henderson did miss this past Sunday’s game against Green Bray. Coach Leslie Frazier didn’t expand on why Henderson was absent but did say he missed the game due to personal reasons.
