Soap star Freddie Smith has officially been charged with vehicular assault and misdemeanor DUI charges after crashing his vehicle while under the influence in Ashtabula, Ohio on October 7th, 2014.

Smith was visiting his hometown of Ashtabula and was driving with his girlfriend, actress Alyssa Tabit. Apparently, Smith lost the control of his vehicle on a curve and ended up in a ditch, causing his vehicle to flip over.

Tabit ended up getting trapped in the car and did sustain some serious injuries. She is currently recovering. Smith also sustained some minor injuries.

Police arrived to the scene and concluded that he was legally drunk at the time of the crash. His blood-alcohol level was .093.

Smith’s attorney has yet to make a comment.

Freddie Smith plays the character of Jackson “Sonny” Kiriakis on ‘Days of Our Lives’. Sonny is the first openly gay contracted character on the show. Smith earned a Daytime Emmy Award nomination for the part in 2013.

Besides his stint on ‘Days of Our Lives’, Smith also played Marco on The CW’s ‘90210’.

If convicted of vehicular assault, Smith could be facing a prison term of up to 18 months. He could also lose his license for up to five years depending on the details of his case.

Ohio DUI cases are commonly referred to as OVI, or operating a vehicle while intoxicated. Smith may have to face additional jail time and a license suspension depending on what the court concludes. Additionally, Smith may also have to pay some expensive fines, seek treatment for alcohol abuse, and complete community service.
