Bob Avellini, an NFL quarterback who played for the Chicago Bears and New York Jets, is set to go to trial for his most recent felony DUI on December 1.

61-year old Avellini was arrested for a felony DUI in Roselle, Illinois in September 2013. His blood-alcohol concentration was twice the legal limit. At the time of his 2013 arrest, Avellini was just nine days in to his probation for a 2012 DUI arrest.

As a matter of fact, Avellini has been arrested for a DUI six times since 2002, but managed to beat half his DUI charges in the past.

Avellini was expected to enter a plea in court today, October 31, 2014 in DuPage County Court. However, his attorney managed to get Avellini a delay so he could travel to California to handle a workers’ compensation claim that he filed against the Chicago Bears three years ago. Avellini is seeking compensation for numerous injuries he endured during his tenure on the Bears. Since California is one of the few states that allows people to file claims on collective injuries, Avellini opted to file in that state. (Many former athletes often do.)

Avellini’s attorneys are expecting a plea deal in his DUI case, despite Avellini’s failure to accept a deal or seek a trial during today’s hearing.

Since his DUI arrest, Avellini has been abstaining from alcohol and submitting to weekly tests. He was required to wear an alcohol-monitoring anklet, but that was removed this past spring due a rash. Furthermore, Avellini’s attorneys stated that he has since received treatment for alcohol abuse in Florida.
